01The rule that decides it
The Gambling Act 2005 regulates providing facilities for gambling to consumers in Great Britain. Since the 2014 amendment the test is where the customer is, not where the operator or its servers are. A venue rendered inside Decentraland is remote gambling in exactly the way a website is: the communication is remote, so the licence requirement follows the player home.
02Prizes of money or money's worth
Gambling requires a prize of money or money's worth. An in-world item that can be sold on a market for a token that trades against sterling is money's worth on any reading, which is why the "it is only cosmetic" argument fails wherever a resale market exists. This is the same reasoning the Commission has applied to skin betting on third-party sites.
03Loot boxes and the limits of the current law
The 2020 call for evidence and the 2022 government response concluded that loot boxes purchased with real money and opened for a randomised in-game item generally fall outside the Act where the item cannot be cashed out, and addressed the harm through industry measures rather than legislation. That is a decision about one mechanic, not a metaverse carve-out, and it turns on cash-out — the moment an item is redeemable, the analysis changes.
04What is genuinely unsettled
Nothing published resolves how the Commission would treat a venue whose operator is a smart contract with no controlling mind, or how licence conditions on advertising apply to a persistent building a player walks past. These are open questions of application, not gaps in the underlying duty.
